Section 8 company vs trust vs society — which should I pick?
Section 8 is the strongest for grants and CSR money: corporate governance, perpetual succession, single MCA registration valid all-India. Trusts and societies are cheaper to register but harder to scale beyond a state. Most serious NGOs choose Section 8.
Do I need 12A & 80G immediately?
Yes if you plan to raise donations. 12A makes the NGO's own income tax-exempt; 80G lets donors claim 50% (or 100%) deduction on what they give. Without both, serious donors and CSR teams won't write cheques. The Donor-Ready plan covers both upfront.
What's the minimum requirement?
Private Section 8: 2 directors, 2 members. Public Section 8: 3 directors, 7 members. At least one director must be an Indian resident. No minimum capital.
Can a Section 8 company distribute profits?
No — that's the whole point. All income must be applied to the objects (charity, education, science, etc.). Salaries and reasonable expenses are allowed; dividends are not.
